GENERAL TERMS
- Services are all events and courses offered by family constellation VIRTUAL and the family constellation VIRTUAL ACADEMY (both in the following ‘FCV’), including email support.
- Events are either online or in-person meetings of FCV as a group or one-on-one.
- Courses are online training of FCV.
- The FCV service is not health therapy or a substitute for it, but it can enhance mental, emotional, and physical well-being and is intended to educate and provide self-help tools.
- You (the participant) are solely responsible for your own health and well-being. Neither the facilitator, trainer, organiser, nor any other second or third party involved in the service of FCV, including owners, directors, partners, staff, or volunteers, is responsible for any physical or emotional distress or injury that may be sustained before, during, or as a result of the service.
- The participant confirms that they are not predisposed to or suffer from any form of mental or physical impairment that renders them incapable of receiving the service. They confirm not to have been diagnosed with a disorder, condition or injury that might make it inadvisable to receive the service.
- To participate in any FCV service, you must be 18 years or older. You confirm upon booking the service that you are older than 18.
- Except in cases of intentional misconduct or gross negligence, FCV accepts no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to, damages in the form of data loss, failure to operate lost revenue, or missed profits.
- Participants can be excluded from an FCV service if they don’t comply with the etiquette, especially when their behaviour implicates intoxication, displays inappropriate behaviour, uses abusive language or acts in any other unacceptable way towards FCV or other participants at events, in group chats or on social media. FCV adheres to a strict ‘non-bullying’ policy.
- By booking and paying for any FCV service, you agree to these terms & conditions and to allow FCV to collect and use your data as necessary to provide the service. This will be done in accordance with our privacy policy.
- Any disputes arising out of this agreement are governed by New Zealand law and must be brought before the courts of New Zealand.
EVENTS
- The participants can choose any name on Zoom and change it at any time during the event or leave the event at any time without any reason.
- After booking the event payments will not be refunded when the participant is cancelling or doesn’t show up at the event. If a workshop has been booked and the notice of cancellation is received by us more than 7 days prior to the start of the event the participant can book a future event in the same category and will receive a 50% discount upon request. If a one-on-one session has been booked, the participant can ask to re-schedule once with a notice period of 48 hours prior to the appointment without any extra costs involved. Otherwise, no refund is given.
- FCV can reschedule the event once for one or all of the following reasons: insufficient participants, an indisposed facilitator, technical problems with hosting the event, or natural or manmade local or global circumstances prohibiting hosting the event. If the event cannot be rescheduled and has to be cancelled by FCV, a full refund for payments on this event will be given within 14 days.
- The participant is NOT PERMITTED to record the event, take screenshots or screen-record parts of or the whole event or to use any of these materials to copy or share it either privately or in public.
- The training modules (2020 – 2024) are recorded for private viewing via YouTube by the participants. The trainees and FCV have sole access to the videos and agreed not to make the videos or part of them available to third parties to respect everyone’s right to privacy and our privacy policy, including not to screen-record or take screenshots.
COURSES
- Upon enrolling in a course, the student gains immediate access to the course material for the duration of the course. The course starts the day of booking and ends the day after the duration is over. FCV service is provided for the course’s duration.
- When the course has ended, the student cannot access the course material any more unless they are current subscribers to the live events.
- The course description is intended to indicate only the general nature of the course and does not guarantee content. FCV reserves the right to amend the course and alter details at its discretion. Courses may be withdrawn at any time, subject to 3 months prior notice.
- The course content is on an ‘as is‘ basis and may contain errors. The information provided should not be construed as being professional advice. Therefore, you are responsible for your own results and outcomes, and FCV is not responsible if you don’t meet the course requirements.
- The course fee must be paid in full upon booking. Access to the course will not be granted or maintained if the payment is revoked.
- Following the course booking, a refund cannot be offered.
- All materials – including but not limited to text, photographs, video, audio, images and any other content – appearing via the course and/or on the Website are protected by copyrights and/or other proprietary rights belonging to FCV and/or other third parties. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in NZ, the US, UK and any other jurisdiction from which you are accessing the Website.
- You may not copy, reproduce, duplicate, screen shot or screen record, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the course and/or on the Website. You may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. The course content is for personal, non-commercial use only and not intended to be share anywhere with others, including social media.
- You agree to maintain the security of any username and password required to access the course and not share your credentials with anyone. You will notify FCV promptly if you become aware of any unauthorised use of your username and/or password. Only you may access the course using your login details.
- The course is facilitated through an online learning management system. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to a stable and fast internet, to be able to participate in the course. FCV is not be responsible for any errors or failures in relation to your ability to access the course, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on FCV’s or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system.
